General Booking Conditions

1. APPLICATION

1.1 These General Terms and Conditions apply to all offers, reservations, and agreements related to all vacation villas and other facilities rented by Bronbella Residences N.V. (Bronbella) or companies booked through Bronbella.

1.2 In these General Terms and Conditions, ‘tenant’ refers to the person who enters into an agreement with Bronbella regarding the rental/use of the vacation villa. ‘User’ refers to the tenant and the persons specified by the tenant who will use the vacation villa and/or other facilities rented by the tenant.

1.3 These General Terms and Conditions apply regardless of your (prior) reference to any own terms or other general terms and conditions. Bronbella rejects all General Terms and Conditions referred to by you or used by you.

1.4 Deviations from these General Terms and Conditions are only valid if agreed upon in writing.

2. RESERVATIONS

2.1 Bronbella only accepts reservations from persons aged 18 years or older. Reservations by persons younger than this age are not valid.

2.2 Bronbella accepts reservations starting from 2 nights on its own website. On external booking pages, the minimum stay is 7 nights.

2.3 If Bronbella processes your reservation, Bronbella will send you a written confirmation and invoice within 24 hours after making the reservation. You must check this immediately upon receipt for accuracy. Any inaccuracies must be reported to Bronbella immediately.

2.4 If you do not receive a written confirmation/invoice within 2 days after making the reservation, you must immediately contact the reservations department. Failing to do so means you cannot claim the reservation.

2.5 An agreement between you and Bronbella is established whereby Bronbella rents the vacation villas, owned by third parties, to you. Bronbella has acquired the right to do so through an irrevocable agreement with the owner and is authorized on behalf of the owner to conclude rental agreements with tenants.

2.6 An agreement between you and Bronbella is concluded at the moment Bronbella has sent the written confirmation of your reservation and the invoice to you.

2.7 The agreement concerns the rental of the vacation villa and/or other facilities for recreational use, which is by its nature of short duration.

3. CHANGES TO THE AGREEMENT

3.1 If you wish to make changes to the agreement after its conclusion, Bronbella is not obliged to accept them. It is at Bronbella’s discretion to determine whether and to what extent these changes are accepted. If Bronbella accepts your changes, Bronbella may charge you change fees.

4. SUBSTITUTION

4.1 It is not permitted for the entrepreneur, the tenant, and other users to assign the vacation villa to others than the persons named in the agreement under any name or from any cause, unless otherwise agreed in writing with Bronbella.

4.2 If you and Bronbella have agreed that you and/or one or more users will be replaced, you remain jointly liable, in addition to the tenant and/or users you and/or other users replace, for payment of the remaining part of the rent, the change fees (see Art. 3.1), and any additional costs due to the replacement and any cancellation costs.

5. PRICES

5.1 You are obliged to pay Bronbella the agreed rental price, as stated in the written confirmation and invoice of the reservation. If Bronbella’s costs (personnel, energy, taxes, etc.) have demonstrably and unforeseeably increased after the conclusion of the agreement, Bronbella has the right to increase its prices and charge you the increased price. If this price increase is implemented within 3 months after the conclusion of the agreement, it will not exceed 5% of the previously agreed price, and you have the right to cancel the agreement on that ground.

5.2 Price discounts and/or special offers cannot be used anymore once the confirmation of the reservation/invoice has been sent by Bronbella.

6. ADDITIONAL COSTS

6.1 In addition to the rental price, you/the tenant are liable for any taxes, such as VAT, and contributions to other service costs.

7. PAYMENTS

7.1 Reservations must be paid in full with at least 25% of the total stay costs on the day you place the reservation, otherwise the reservation will not be confirmed. The remaining amount must be fully paid upon check-in. Check-in time is from 15:00 onwards. If you check in after 16:00, you must pay the total amount of the reservation in advance.

7.2 Our prices are in USD, but can be paid in EUR or SRD at the local daily rate (cash, debit card, or bank transfer). We only accept local debit cards. Credit card payments are only possible with Visa credit cards. Credit card payments will be charged 4% of the total amount payable. Cash payments in USD or EUR will be charged 1.5% of the total amount payable. These costs are equivalent to the costs our bank charges for credit card services or for depositing funds.

7.3 In case of late payment of the amounts invoiced to you, you will be in default immediately after the payment term has expired. In that case, Bronbella will offer you the opportunity in writing to pay the outstanding amount immediately. If payment is still not made, Bronbella reserves the right to terminate (cancel) the agreement from the day after the 24-hour period has expired, and you will be liable for all damages that Bronbella has incurred or will incur as a result, including all costs that Bronbella has had to incur in connection with your reservation and cancellation. Bronbella also has the right to charge cancellation costs per vacation villa. In that case, the provisions of article 13 apply.

7.4 Bronbella always has the right to set off claims against you from any source with amounts paid by you from any source.

8. ARRIVAL AND DEPARTURE

8.1 The rented vacation villa can be occupied from 15:00 on the agreed day of arrival, as stated in the reservation confirmation. The vacation villa must be vacated before 12:00 on the agreed day of departure, as stated in the reservation confirmation.

8.2 If you wish to extend the agreement with Bronbella for longer than the agreed duration and Bronbella agrees to this, Bronbella is always entitled to designate another vacation villa.

8.3 If the use of the vacation villa and/or other facility ends earlier than on the agreed date stated in the reservation confirmation, the tenant is not entitled to a refund of (a portion of) the rental price and/or costs.

9. REGULATIONS

9.1 All guests and visitors must adhere to the rules established by Bronbella, including the visiting regulations, house rules, and pool rules, as well as any additional rules applied in emergencies. These regulations can be requested and found in the information folder of your vacation villa.

9.2 According to local regulations, guests are required to identify themselves during check-in. If guests cannot show identification, Bronbella may not accommodate them.

9.3 Each vacation villa has a maximum number of persons allowed to stay in it: Junior 3 persons, Queen 4 persons, and Family 6 persons. Each bedroom is respectively for 1 or 2 persons except for a baby up to 2 years.

9.4 Smoking is not allowed inside the vacation villa. There is opportunity to smoke on the terrace of the balcony or front of the parking lot.

9.5 Bronbella reserves the right to make changes to the setup and opening hours of the resort’s facilities. You will allow necessary maintenance to be carried out during your stay at the vacation villa or other facilities without entitlement to compensation.

9.6 Certain facilities may be temporarily unavailable due to maintenance or renovations. Bronbella is in no way liable for these interruptions and is not obliged to compensate damages or costs to the tenant and users.

9.7 The tenant must leave the vacation villa in a swept clean condition (no dirty dishes, bedding removed, trash bags in the garbage bin, empty fridge) and leave the vacation villa tidy. Bronbella may charge USD 100 if the vacation villa is not left swept clean.

9.8 The tenant must use the inventories provided in the vacation villa. If it appears that there is damage due to improper use of the inventories, the tenant must pay for this at check-out.

10. CANCELLATION POLICY

10.1 It is advisable to take out a cancellation insurance policy. This way, you can reclaim the rental price if you are forced to cancel the reservation.

10.2 Cancellation can only be done via written communication via email or WhatsApp.

10.3 If a reservation is canceled, the tenant is liable for cancellation costs. These costs are 100% in high season and 75% in low season of the booking amount.

11. DISSOLUTION

11.1 Bronbella has the right to terminate the agreement at any time with immediate effect,
if it appears during your reservation and/or stay that you have provided incorrect information and/or if you have
has not strictly complied with the payment terms. Bronbella also has the right to, with
with immediate effect, to terminate the agreement and refuse you access to the holiday villa,
if you and/or other users, despite prior warning, fail to fulfill the obligations under the
agreement, the house rules, the instructions of the staff or the government regulations
properly complies, or if you and/or other users due to your behavior (noise pollution,
drunkenness, use of drugs, etc.) the good atmosphere at and/or in the immediate vicinity of the resort
spoil. In that case you are not entitled to a refund of (part of) the rental amount and/or other costs
cost. Bronbella reserves the right to recover further damages from you.

11.2 If Bronbella has to make interim changes to these General Terms and Conditions, it will

12. LIABILITY

12.1 Bronbella accepts no liability for: theft, loss or damage of any kind
nature, during or as a result of a stay in one of our holiday villas.

12.2 The tenant and the user are jointly and severally liable for all loss and/or damage caused by
Bronbella and/or any third party has arisen as a direct or indirect result of their stay, regardless of whether this is
caused by actions or omissions of the tenant and/or users, or by third parties acting through
at the resort through their fault, as well as for all damage caused by any animal and/or
thing they have under them.

12.3 If the rented property has not been left properly by the tenant/user, in addition
the additional cleaning costs (EUR 25), any damage repair and renewal costs
are brought to the tenant/user.

13. FORCE MAJEURE

13.1 Force majeure on the part of Bronbella exists if the execution of the agreement is complete
or partially, temporarily or otherwise, is prevented by circumstances beyond the control of
Bronbella, including war, danger of war, civil war, riot, strike,
worker exclusion, transport difficulties, fire, natural disasters and other disruptions or
events.

13.2 In the event of force majeure, Bronbella can rely on art. 13.1 and therefore the agreement
suspend or cancel with tenant and user.

14. COMPLAINTS

14.1 Despite Bronbella’s care and efforts, you may be of the opinion that you have a
have a justified complaint regarding your holiday accommodation. Complaints should always be addressed first
on site and directly to the resort management. If the complaint is not satisfactory
are processed, you have the opportunity to do so no later than 1 month after departure from the resort
submit a complaint in writing to:

14.2 The complaint will then be handled with the utmost care. Shouldn’t come from this either
If a satisfactory solution is reached, you have the option to submit your complaint to the
Tourism and Travel Disputes Committee or another competent court.

15. GENERAL

15.1 All reservations and agreements are exclusively governed by Surinamese law.

15.2 Bronbella Residences N.V. will include your data in a database. With entering into
of an agreement with Bronbella, you give us permission to use and store your
facts. The data will be used for our guest administration. We strive for your
to only use data internally and not to provide it to third parties unless this is necessary
for the performance of our services or when this is required by law and regulations.
In any case, Bronbella complies with the applicable regulations regarding the
protection of personal data.
